A decision to make customers take a bus tour instead of the luxury European river cruise they were promised could cost Scenic Tours up to $16m.
The NSW Supreme Court ruled ruled that Scenic had effectively ripped-off its clients – some of whom had paid $10,000 a head – by not offering a refund or alternative cruise when heavy flooding during 2013 made rivers impassable.
Scenic argued its customer contract meant it was not liable for itinerary variations. See story.
UPDATE: Scenic has told Travel Daily it will be appealing the decision and also disputed the estimated payout figures without providing an alternative.
